By accessing or using Skalap ("the App"), a service provided by Koda, located in Switzerland, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
Skalap is an AI-powered video analysis application that helps TikTok creators understand why videos go viral. The App analyzes video content, captions, engagement metrics, and trends to provide insights and recommendations.
3.1. You must create an account to use certain features of Skalap.
3.2. You are responsible for maintaining the confidentiality of your account credentials.
3.3. You must be at least 13 years old to use this App, or the minimum age required in your jurisdiction.
3.4. You agree to provide accurate, current, and complete information during registration.
4.1. Skalap integrates with TikTok through official APIs. By connecting your TikTok account, you authorize us to access your public profile information and video data as permitted by TikTok.
4.2. We only access data that you explicitly authorize through TikTok's OAuth process.
4.3. We are not affiliated with, endorsed by, or sponsored by TikTok.
You agree NOT to:
5.1. Use the App for any illegal purposes or in violation of any laws.
5.2. Attempt to reverse engineer, decompile, or hack the App.
5.3. Use automated systems (bots) to access the App without permission.
5.4. Upload malicious code, viruses, or harmful content.
5.5. Violate TikTok's Terms of Service or Community Guidelines.
5.6. Resell or redistribute the App or its analysis without authorization.
6.1. Skalap offers free and paid subscription tiers.
6.2. Subscription fees are billed in advance on a monthly or annual basis.
6.3. All payments are processed securely through Stripe or Apple In-App Purchase.
6.4. Subscriptions automatically renew unless canceled before the renewal date.
6.5. Refunds are handled according to Apple's App Store refund policy or our refund policy for direct purchases.
6.6. We reserve the right to change pricing with 30 days' notice to active subscribers.
7.1. Skalap uses artificial intelligence to analyze videos. AI-generated insights are provided "as is" and should be considered as suggestions, not guarantees.
7.2. We do not guarantee that following our recommendations will result in viral content or increased engagement.
7.3. Analysis results may vary and depend on multiple external factors beyond our control.
8.1. Skalap, its design, features, and technology are owned by Koda and protected by international copyright, trademark, and other intellectual property laws.
8.2. You retain ownership of your TikTok content. We do not claim ownership of videos you analyze.
8.3. By using the App, you grant us a limited license to process your videos for the purpose of providing analysis.
9.1. Your use of Skalap is also governed by our Privacy Policy.
9.2. We collect and process data as described in the Privacy Policy.
9.3. We do not sell your personal data to third parties.
9.4. We comply with Swiss data protection laws and GDPR where applicable.
10.1. We may temporarily store videos for analysis purposes.
10.2. Videos are automatically deleted after analysis is complete, typically within 24 hours.
10.3. Analysis results and metadata may be stored in your account history.
10.4. You can request deletion of your data at any time through the App settings.
11.1. You may cancel your account at any time through the App settings.
11.2. We reserve the right to suspend or terminate accounts that violate these Terms.
11.3. Upon termination, your right to use the App ceases immediately.
11.4. Termination does not relieve you of any obligations incurred before termination.
12.1. THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
12.2. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12.3. WE ARE NOT RESPONSIBLE FOR ACTIONS TAKEN BASED ON AI ANALYSIS.
13.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KODA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
13.2. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRIOR TO THE CLAIM.
13.3. Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
You agree to indemnify and hold Koda harmless from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
15.1. We may update these Terms at any time.
15.2. Material changes will be notified via email or in-app notification.
15.3. Continued use of the App after changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of Switzerland. Any disputes shall be resolved in the courts of Switzerland.
17.1. The App integrates with third-party services (TikTok, Google Gemini, Stripe).
17.2. Use of these services is subject to their respective terms and policies.
17.3. We are not responsible for third-party service failures or changes.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Koda regarding the use of Skalap.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
